Frequently Asked Questionsसामान्य प्रश्न एवं उत्तर

General practice refers to a law practice that covers multiple areas of law — civil, criminal, family, and routine court matters — without focus on a single subject area. At ASK Law Xperts, all advocates — including those in general practice — work under the supervision of senior advocates and in conformity with BCI professional standards.

To become an advocate in India: (1) Complete a recognised law degree — LLB (3-year) or BA.LLB / BBA.LLB (5-year integrated); (2) Enrol with the State Bar Council of the state where you wish to practise — by paying the enrolment fee and submitting required documents; (3) Once enrolled, you receive an Enrolment Certificate and are entitled to practise law before courts in India. The Bar Council of India oversees standards and the All India Bar Examination (AIBE) must be cleared for a Certificate of Practice.

The All India Bar Examination (AIBE) is conducted by the Bar Council of India. Every advocate enrolled after 2010 must pass the AIBE to obtain a Certificate of Practice — which is required to actively appear before courts. The exam tests knowledge of substantive and procedural law. Advocates enrolled before the AIBE system was introduced are not required to take it.

A vakalatnama is a written authority — executed on a stamp paper — by which a client authorises a specific advocate to appear and act on their behalf in a legal proceeding. It is required to be filed in court before the advocate can appear for the client. Without a vakalatnama on record, the advocate's appearance may not be recognised. Different courts have specific forms and requirements for vakalatnamas.
